Tittle: So That Your Foot May Not Slip Over Unjust Takfeer

The issue regarding which I will be speaking to you tonight, is a matter that is extremely important. So lend me your ears and I specifically mention my Mujahid brothers.

So that your foot may not slip…

It is a matter in which a lot of hearsay based on “it is said” and “they said”… has become widespread.

If we were seeking the guidance of the Quran, we would have followed the statement of Allah, “But if they had referred it back to the Messenger or to those of authority among them, then the ones who [can] draw correct conclusions from it would have known about it“.

Dear brothers,

The ignorance of a lot of brothers on this issue is a reason for their feet to slip.

We ask Allah for firmness.

And we say and from Allah we seek help…

Oh you blessed one: So that your foot may not slip over unjust Takfeer and you come under his saying, may the peace and blessings of Allah be upon him, “Any person who says to his brother, “Oh Kafir!”, then indeed one of them has surely brought it upon himself”.

So that your foot may not slip over unjust Takfeer, I will narrate to you quickly in brief, the statement of the people of knowledge regarding the issue of seeking help from kaafirs against Muslims.

And before talking about the issue of seeking help, we must speak with clarity about the situation of the fields of Jihad today and the reason for this issue to be serious.

One of the brothers came to me and said, “Oh Shaykh, such and such group has apostatized from the religion of Allah”.

I asked him, “Why”?

He said, “They sought help from the disbelievers against those transgressing…”, and he meant Baghdadi’s group.

So I told him, “Is this from the nullifiers of Islam?”

And he replied in amazement, “Is there a difference of opinion on this matter?”

So I narrated to him the statements of the scholars and their evidences for it and he was surprised and he then asked me to write this in my series of statement releases.

So I say seeking the help from Allah and I ask Allah to inspire me towards my guidance…

This is not the place to decide on what is the most correct view but its compilation is about the position of the people of knowledge. So that your foot may not slip and you declare the Mujahideen as disbelievers incorrectly and you destroy your Jihad.

Know oh you blessed one, so that your foot may not slip, it is prohibited by the consensus of the scholars to support the Mushriks and give them victory in their war against any population of Muslims or a Muslim group.

And know that supporting the Mushriks over them is from amongst the nullifiers of Islam and a clear apostasy from the religion of Allah like the one who supports NATO in the fight against the Mujahideen.

Shaykh Ibn Baz said in his Fataawa, “The scholars of Islam have unanimously agreed that whoever supports the disbelievers over the believers and assisted them by any kind of assistance is a disbeliever just like them”.

And Shaykh Ahmed Shaakir said, “As for cooperating by any type of cooperation with the English in fighting the Muslims of Egypt whether less or more, it is the extreme apostasy”.

And so that your foot may not slip, know that: “SUPPORTING” is not the same in judgment as “SEEKING HELP”, since “supporting” would mean from those who claim to be Muslims towards the disbelievers over the Muslims. So the disbelievers are the ones who control the matters here.

The disbelievers in this case of support, they are the ones who made the preparations for this war. So they are the ones who called those who claim to be Muslims to join them. And this is Kufr (disbelief).

And so that your foot may not slip, a confirmation must be made regarding a matter that has been agreed upon by the scholars i.e. – Seeking of help by Muslims from disbelievers against disbelievers is not discussed under Takfeer by the scholars nor has the predecessors gone to declare its doer as a disbeliever.

And from what has been agreed upon is that the Fuqaha (Jurists) do not make Takfir on the Muslim who seeks help from the disbeliever over an oppressing transgressing Muslim while he (the help seeker) has the command over the disbeliever and his flag is raised over him. And the benefit for the Muslim is predominant over the benefit of those besides him.

And we do not mean by us not making Takfir on him to mean permission for it but rejecting making Takfir on its doer. As for the explanation of our issue, I mean: – Seeking help from a disbeliever over a transgressing Muslim while the command and power is for the Muslim.

The most correct view is that of the majority of the Fuqaha (jurists) which is “prohibition and treating it as a crime in all situations”. And it is the statement of the Malikis, Hanbalis, Shafiees and the Hanafis differed over that.

And so that your foot may not slip, pay attention to the fact that those who prohibited and condemned it, while being the majority, have not made takfir on the one who makes it permissible to seek help. So the distinction is between making takfir and prohibiting and it does not mean the matter is to be taken lightly.

And if they were transgressing oppressors and obedience is made for the kuffars’ orders and prohibitions, then the flag of kufr would be raised.

Therefore, this grave matter must never be taken lightly.

And so that your foot may not slip, be cautious and may Allah have mercy on you, that the matters of Ijtihad (independent research) over which scholars have differed upon, does not become Kufr or apostasy.

And here we caution the leaders of the battalions twice and thrice about the huge difference between seeking help from a subservient disbeliever against a transgressing Muslim and from seeking help from a disbeliever who is the one commanding and controlling.

And so that your foot may not slip, be aware that if a man seeks the help of a Kafir who you see as a Kafir while he does not see him as a Kafir in a matter of acceptable Ijtihad, then that is a permissible difference and what we have stated does not apply to him.

And so that your foot may not slip, be cautious and may Allah have mercy on you, that if a Muslim and a Kafir simultaneously at the same time fight against the transgressors without any mutual agreement, then it is not considered as seeking help. And this is an important matter.

This is a statement that I see as extremely serious. So ponder over it and spread it. May Allah raise your status. May Allah make me and you steadfast and protect us from errors.

#حتى_لاتزل_قدمك في التكفير بغير حق

الأمر الذي أحدثكم عنه هذه الليلة
فهي قضية في غاية الأهمية فأعيروني أسماعكم وأخص إخوتي المجاهدين


إنها مسألة كثر القيل والقال فيها
ولو اهتدينا بهدي القرآن لاتبعنا قول الله: ولو ردوه إلى الرسول وإلى أولي الأمر منهم لعلمه الذين يستنبطونه

أيها الإخوة
إن جهل كثير من الإخوة بهذه القضية مدعاة لتزل أقدامهم نسأل الله الثبات

فنقول وبالله نستعين

أيها المبارك: #حتى_لاتزل_قدمك في التكفير بغير حق فتدخل في قوله صلى الله عليه وسلم: أيما امرئ قال لأخيه: يا كافر! فقد باء بها أحدهما

حتى_لاتزل_قدمك في تكفير مسلم بغير حق ، فإني أسرد لك على عجالة كلام أهل العلم في مسألة الإستعانة بالكافر على المسلم

وقبل الحديث عن مسألة الاستعانة
يجب أن نتكلم بوضوح عن حالة الساحة الجهادية اليوم ، وما سبب خطورة هذه المسألة

جائني أحد الإخوة فقال
ياشيخ الجماعة الفلانية ارتدت عن دين الله ؟
فقلت لم ؟
فقال: استعانت بكافر على قتال البغاة .. يعني جماعة البغدادي

فقلت وهل هذا الأمر ناقض من نواقض الإسلام فقال متعجباً وهل في هذا الأمر خلاف
فسردت له أقوال العلماء وأدلتهم فيها فتعجب فطلبني أن أكتب هذا الأمر في سلسلة تغريدات

فأقول مستعيناً بالله وأسأل الله أن يلهمني رشدي

ولست هنا بمعرض الترجيح في هذه المسألة ، ولكن وضعها في موضعها عند أهل العلم #حتى_لاتزل_قدمك فتكفر المجاهدين بغير حق فتوبق جهادك

اعلم أيها المبارك: #حتى_لاتزل_قدمك
أنه يحرم بالإجماع إعانة المشركين ونصرتهم في حربهم ضد أي شعب مسلم أو جماعة مسلمة
واعلم أن إعانة المشركين عليهم ناقض من نواقض الإسلام، وردة صريحة ، عن دين الله كمن يعين الناتو على قتال المجاهدين

وقال الشيخ ابن باز في فتاواه أجمع علماء الإسلام أن من ظاهر الكفار على المسلمين وساعدهم بأي نوع من المساعدة فهو كافر مثلهم

وقال الشيخ أحمد شاكر: أما التعاون بأي نوع من أنواع التعاون مع الإنجليز في قتال المسلمين بمصر قل أو كثر فهو الردة الجامحة

و #حتى_لاتزل_قدمك اعلم أن
الإعانة ليست في الحكم كالاستعانة، فالإعانة تكون ممن يدعي الإسلام للكفار على مسلمين، فالكفار هم أصحاب القضية هنا

الكفار في هذه حالة الإعانة هم الذين أعدوا العدة لهذه الحرب، وهم الذين دعوا من يدعي الإسلام إلى الانضمام إليهم، وهذا كفر

و #حتى_لاتزل_قدمك يجب تقرير أمر متفق عليه:أن استعانة المسلم بالكافر على الكافر ليست من مباحث التكفير عندالعلماء ولم يتطرق السلف لتكفير فاعلها

ومما هو متفق عليه أن الفقهاء لا يكفرون المسلم الذي يستعين بالكافر على مسلم ظالم باغ وهو الآمر على الكافر وله الراية عليه

ومصلحة المسلم اظهر من مصلحة غيره ، ولايعني قولنا عدم تكفير فاعل ذلك القول بالجواز ولكن نفي تكفير فاعل ذلك

وأما تفصيل مسألتنا أعني
*الإستعانة بالكافر على المسلم الباغي والأمر والسطوة للمسلم
الراجح وهو قول جمهور الفقهاء: التحريم والتجريم بكل حال
وهو قول المالكية والحنابلة والشافعية وخالف الحنفية

و #حتى_لاتزل_قدمك تنبه إلى أن من حرم وشنع وهم الجمهور لم يكفروا المبيح للإستعانة ، ففرق بين التكفير والتحريم ولايعني ذلك تهوين الأمر

ولو كانوا بغاة ظالمين فيأتمر بأمر الكفر وينتهي بنهيهم لترتفع راية الكفر

لذا يجب عدم التساهل في هذه المسالة الخطيرة جداً

و #حتى_لاتزل_قدمك فتنبه يرحمك الله إلى أن المسألة الاجتهادية التي يختلف فيها العلماء لا تكون كفراً ولا ردة

وننبه هنا قادة الكتائب ثانيةً وثالثة إلى الفرق الشاسع بين الاستعانة بكافر تابع على مسلم باغ والاستعانة بكافر آمر مسيطر

و #حتى_لاتزل_قدمك فتنبه: إلى أن الرجل إذا استعان بكافر تراه كافراً ولايراه كافراً في أمر اجتهادي يسوغ، فذاك خلاف سائغ لاينزل عليه ماذكرنا

و #حتى_لاتزل_قدمك تنبه يرحمك الله ، أن تواطئ قتال الباغي من كافر ومسلم من غير اتفاق لايعد استعانةً ،، وهذا أمر مهم

هذه تغريداتٌ أُراها بالغة الأهمية ، فتأملها وانشرها رفع الله قدرك ثبتني الله وإياك وعصمنا من الزلل
